TERM & CONDITIONS

In the following Terms & Conditions:​

''Client(s)'' shall mean ''you'' the parties to the contract.

​''Event'' or ''Session'' shall mean the photo shoot/roadside ride by session.

''Photographer'' shall mean Chris Seaman / Biker Images By Chris​.

''Products'' shall mean any prints, digital images or goods supplied.

​''Services'' shall mean photography to be carried out at the venue and any other Service agreed by the Client and Biker Images By Chris.

It is agreed that the Client agrees the following Terms & Conditions, that no modification shall be effective unless agreed by both parties in writing.

Booking Fee:

The booking fee must be paid as set out in the pricing schedule. Both parties acknowledge that the booking fee is non refundable or transferable in the event of a cancellation by the Client.​

Payment in full for the Event must be paid before or on the day of the agreed Event date.​

Payment to be made by Cash, Cheque (Payable to Chris Seaman) or Bank Transfer.

Any returned cheques will attract an administration charge of £25.00​.

Any late payment for the Event will mean the proof images will not be made available to the Client until full payment has been made.​

Failure to make any payment may result in cancellation of the photoshoot.​

Any booked Photo Shoot must be taken within 12 months of the booking being confirmed.

Any Product(s) ordered must be paid for before the Product(s) will be delivered.

Orders must be paid for in full at the time of ordering.​If a Gift Certificate is required for any Photo Shoot the full shoot fee must be paid in full before any Gift Certificate will be supplied.​

An extra charge will be added if the shoot is to take place outside a radius of 25 miles from Ingleton, North Yorkshire. This will be quoted for once the location has been agreed.

A non refundable fee of £150 must be paid before the agreed Event date by the Client for any shoot with a round trip travel distance of over 150 miles from Ingleton, North Yorkshire. This covers the cost of any expenses incurred by Biker Images By Chris if the Client fails to turn up at the agreed location.

Licence and coverage

The Photographer shall be granted artistic licence in relation to the poses photographed and the locations used. Although every effort will be made to comply with the Clients' requirements, the Photographers' judgment regarding the location, poses and number of photographs taken shall be deemed correct and not subject to dispute.​

Whilst the Photographer shall endeavour to fulfil the Clients' requirements, the Photographer can not be held responsible for non-availability of subjects or adverse conditions which may delay the progress of proceedings, preventing the coverage of certain shots.

Any alterations made to the contract by the Clients once the details have been confirmed may only be confirmed at the discretion of the Photographer and should be agreed in writing. Where the Photographer is unable to accommodate alternative arrangements (such as change of venue or date) the Photographer is not liable to compensate the client in any way whatsoever.​​

Image and Product reproduction

All prints and presentation sizes quoted are approximate and subject to change at the discretion of the photographer and may be subject to slight variation. Whilst every effort will be made, the Photographer cannot guarantee exact colour matching and is not held responsible for any colour variation which may occur due to light and location variations.

Most digital images have been cropped during editing & it is not advisable to crop further due to file sizes becoming smaller. Contact Biker Images By Chris for further advice.

Images purchased are not to be edited or manipulated in any way by the Client unless agreement has been made with Biker Images By Chris. Cropping is allowed but at the Clients risk to file size or quality degradation.

Due to limitations of computer monitors and variations of computer operating systems, it is understood that images viewed via this method may appear differently according to the specifications of each monitor/computer and that prints may not match images rendered on any particular computer monitor.​

Where images are being made available on a USB device or CD/DVD Disk, reasonable steps are taken to ensure compatibility, but you the Client acknowledge that USBs or Disks may not play on all devices including and not exclusive to computers.​

Low resolution digital image quality is only good enough for displaying on Web based/App Social Media platforms.

No cash alternative will be offered for any free products offered.​

Please make sure you are ordering the correct digital image(s) or product(s) as once the order is placed it can not be cancelled and refunds can not be given.

There will be no refund or part refund for digital images once the file(s) has/have been delivered by whatever means to the Client. If images are uploaded to a gallery in batches, please wait until the gallery is finished & complete before purchasing multiple images as refunds will not be given if purchases are made before the gallery has been completed!

Reorders

All reorders shall be treated as an extension of the contract and no responsibility for any error will be accepted unless orders are provided in writing.​​

Please make sure when ordering any reorder product(s) that it is the correct image(s) and product(s) as once the order is placed it can not be cancelled and refunds can not be given.

Ownership

All images shall remain the sole property of the Photographer at all times.​

Any products ordered will remain the property of the Photographer until full payment is made.​​

PLEASE NOTE: Purchase of ANY image(s) is/are for personal use only & not for commercial use without written consent from Chris Seaman / Biker Images By Chris.

Copyright​

Any images (including parts of the image) or copies of images whether stored digitally or otherwise and any computer program including any source of object code, computer files or printed documentation relating to such images are protected by the Copyright and Designs Act 1988 and remain the copyright of the Photographer at all times unless there is express written agreement to the contrary. It is contrary to the Act to copy or allow to be copied photographically, electronically or by any other means an image created as part of this contract without the written permission of the Photographer.​

Screenshot or any other form of recording/storing of any image of any media is strictly forbidden without consent from the Photographer.

Removal of any watermark is classed as breach of copyright and a legal offence.

Insurance and Limitations

The Photographer will maintain Public Liability at all times. However, in the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstances, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for any indirect or consequential loss.

It is the Clients responsibility to ensure that the motorcycle is safely parked and or moved at the Event venue. The Photographer will not be held responsible for any damage to the motorcycle occurring during the Event.

Force Majeure

The due performance of this contract is subject to alteration or cancellation due to a Force Majeure Event. A Force Majeure Event means an event beyond the control of a party, which by its nature could not have been foreseen, was unavoidable, and includes, without limitation, acts of God, storms, floods, fire, sabotage, civil commotion or civil unrest, interference by civil or military authorities, acts of war or armed hostilities, or other national or international calamity or one or more acts of terrorism or failure of energy sources. For the avoidance of doubt, it does not include circumstances where the Photographer attend an Event to perform the Services and any of the Parties fail to attend.​​

Conduct

​It is the responsibility of the Client to ensure the co-operative behaviour of all subjects attending with the Client at an Event. Should the Photographer feel unsafe at the contracted photoshoot or be subjected to abuse and the Client cannot control or prevent the situation then the Photographer is entitled to advise the Client of that situation and leave without forfeit on this contract (for example: drunk/abusive behaviour by the Client or any persons with the Client).

Cancellation

Where the Photographer has to cancel an Event, due to circumstances beyond the Photographers control the full amount of any fee paid by the Client will be re-paid to the Client.​ Where it is possible a re-shoot may be arranged (if practicable) however, the Photographer will not be responsible or liable for any additional costs incurred by the Client.​Should the Client wish to cancel the contract at any time, Notice of cancellation must be given in writing to the Photographer. In such circumstances, the Client will be liable to pay the Photographer the following sums:

Any amount already paid by the Photographer for fees involved with the setting up of the Event/Session, including location fees or any props or items purchased specifically for the Event/Session.​​

Complaints

All complaints should be raised by the Client directly to the Photographer in writing within 14 days of the occurrence which gives rise to the complaint. The Photographer will consider the complaint and shall provide a response to the client within 14 days of receipt of the complaint.​​

PLEASE NOTE:

Most of the images displayed on this website, social media platforms or any other media have been edited to the Photographers taste, they are not generally the image you see & receive when purchasing through the website galleries unless previously agreed with Biker Images By Chris!

All Galleries are likely to be removed from the previous year once the next year has completed! ( example: 2021 galleries will be removed once the full 2022 season/year has been completed).

Client transport cost to the Event are not covered by Biker Images By Chris.
